    Continuance Policy

    TRAFFIC CASES: First continuance granted by Clerk. CRIMINAL CASES: Must be agreed to by the Commonwealth’s Attorney (434-392-1902) – Cases including but are not limited to the following: Driving Under the Influence of Alcohol/Drugs, Driving after Revocation-DUI Related, Driving after Revocation-DUI Related, Driving Suspended-Third or Subsequent Offense, Reckless Driving by Speed (Over 90 Miles Per Hour), Reckless Driving-Yield Right of Way to Emergency Vehicle (46.2-861-1), Class 1 Misdemeanors, Class 2 Misdemeanors, Felony Warrants. – If the Commonwealth’s Attorney and the defendant cannot agree on a continuance, the defendant may request a hearing on his/her motion. CIVIL CASES: First Continuance granted by Clerk by agreement of both parties.
